Power of Attorney
Reminder:
1. This power of attorney is presented through an online page. You should express your willingness to authorise by clicking the consent button online. Before doing so, you should fully read the content of this power of attorney, in which the limitations, exemptions or other terms involving your significant rights and interests will be bolded, underlined and so on to prompt you. Obtaining your authorisation means that eSign can use the digital certificate you have generated to sign this authorisation letter.
2. If you do not agree to the Authorisation, you can click on the Decline button online and you will still be able to complete signing this Agreement, but the Authorisation will not take effect.
By signing below, you hereby authorise the designated third party platform (the information of which is subject to system display and hereinafter referred to as the authorised party) to utilise the electronic signature service provided by eSign on your behalf, according to the following terms:
I. Scope of Authorization
1. You hereby authorise sSign to utilise your personal identification information to apply for a digital certificate from a qualified electronic certification service organisation (hereinafter referred to as 'CA organisation') and to store it securely. You or the authorised party can apply for the invocation. You authorise eSign to retain the information related to the above digital certificate for a minimum of five years following the expiration of the digital certificate.
2. You authorise the authorised party to apply directly to eSign to invoke your digital certificate to sign all the contracts required for the provision of services without your further action. The actual content of the signed contracts shall be subject to the provision of the authorised party.
3. The act of the authorised party calling your digital certificate to sign is regarded as your operation, and you are held legally responsible for all results. Should the authorised party exceed the authorised scope of use, leading to disputes, the onus is on you and the authorised party to resolve such issues independently, and eSign does not take responsibility for such outcomes.
4. Please note that the authorisation is valid from the date of signature until (please fill in the expiry date).
II. Terms of Use
1. Please be advised that you must provide true and accurate personal information; any fraudulent use of another person's identity will not be tolerated and you will be held entirely accountable. If your personal information changes within the validity period of the digital certificate, you must promptly notify eSign in writing.
2. Both you and the authorised party are obliged to use the applied digital certificates lawfully, in accordance with the terms of the agreement set out in the authorisation letter. In the event that either you or the authorised party are suspected of violating these terms, eSign reserves the right to apply to the CA organisation for revocation of the relevant applied digital certificates, as well as require the at-fault party to take responsibility for their actions.
3.You understand and agree that eSign is required to retain authorisation records on its servers, including your unique identity information and browser identifier. This is necessary to provide the services detailed in this authorisation letter. eSign are committed to adhering to the provisions of the "Law of the People's Republic of China on the Protection of Personal Information" and associated laws and regulations in the handling of your personal information. We shall refrain from transferring, providing, selling or managing your personal information for any other purpose without your consent.
4. You consent to providing the personally identifiable information and associated documentation submitted via the eSign Services as electronic evidence to the court, should any dispute arise. Additionally, you accept that the electronic evidence generated during the signing and execution of this document may be used as the foundation for resolving any disputes directly.
5. Please be advised that this power of attorney will be signed using an electronic signature and will come into effect from the time you confirm it online by clicking on a box or ticking it. Please note that sub-delegation is prohibited during the validity period of the authorisation.
