Authentication Service Agreement
The Authentication Service Agreement ("Agreement") is a valid contract between ESIGN SG HOLDING PTE. ("eSign" or "we" or "us") and the user (hereinafter referred to as "you") regarding the use of the authentication service (hereinafter referred to as the "Service").
Please read this Agreement carefully as it will help you understand the content of the Service and your rights and obligations.
To facilitate your use of the Service, by clicking on or otherwise acknowledging this Agreement through a web page, you are deemed to have fully understood all of the terms of this Agreement and agree to enter into and be bound by this Agreement with e-Signature.
This Agreement shall take effect on the date of 2022.
I. Definition
User: refers to the subject of using e-Signature authentication service, the user can be an individual or an enterprise.
Authentication Service: refers to the service that eSign obtains your identity information through your authorization on Singpass webpage (https://www.singpass.gov.sg) to confirm the authenticity of your identity.
II. Authorization and License
2.1 In order to provide the Service to you, the Supplier is required to provide the information (e.g. name, ID number, cell phone number, etc.) that you have filled in or retained in the process of applying for the Service to eSign.
2.2 In order to accurately verify your identity and try to prevent your identity from being fraudulently used, you authorize e-Signature to collect your device information to verify whether you are in a trusted environment when performing authentication, and to collect your name, ID number, cell phone number, business name, business ID number, business operation status and other information as required according to your authorization.
III. Your rights and obligations
3.1 You shall not use the Service in areas that are restricted or prohibited by Singapore laws and regulations or against moral customs, otherwise you shall be liable for any losses suffered by e-Signature or third parties as a result.
3.2 If you find that our collection and use of your personal information violates the laws and administrative regulations or violates the agreement with you, or if you find that your personal information collected or stored by us is incorrect, you may inform us via customer service telephone +86- 400-087-8198 and request deletion or correction.
3.3 You should be aware that the Service is based on the authority of Singpass and that e-Signature trusts the authenticity of the identity of the individual or business transmitted to e-Signature via Singpass.
3.4 You acknowledge that eSign authenticates your identity through the authentication methods provided by the Service, and you shall keep the information, materials and equipment that can authenticate your identity. If the relevant information, materials or equipment are leaked, lost or otherwise out of your control, you shall promptly notify e-Signature, otherwise e-Signature shall have the right to determine that the corresponding authentication is completed by you.
3.5 You shall abide by the laws and regulations of Singapore when using the Service and shall not use the Service for any illegal purpose or in any illegal way.
IV. e-Signature's Rights and Obligations
4.1 eSign shall provide the Service to you in accordance with this Agreement.
4.2 eSign will continuously adjust and improve the content and form of the corresponding authentication service according to the development of authentication technology and the needs of the market risk environment.
4.3 The personal information handled by eSign in providing the certification service is limited to the information necessary to perform the certification service. eSign has the right to handle your personal information if you use the certification service.
4.4 In addition to protecting your personal information in accordance with laws and regulations and this Agreement, we will strictly protect your information in accordance with e-Signature's Privacy Policy when processing your information. Please read this statement carefully on eSign's website and feel free to contact us if you have any questions.
V. Exclusion of Liability
You understand and agree that, given the special nature of computers and the Internet, the following circumstances are not a breach of contract by eSign: 1) failure to provide or interruption of the Service due to natural disasters such as floods, earthquakes, plague epidemics, etc., as well as social events such as war, unrest, governmental actions, interruption of telecommunication backbone lines, network blockage, technical adjustment of telecommunication departments and governmental control; 2) hacker attacks resulting in service interruption, information data leakage; however, we shall provide the Service in accordance with this Privacy Policy. (3) eSign needs to interrupt the service for a short period of time during server configuration and maintenance; (4) the access speed of your website decreases due to the blockage of the Internet; (5) the service is interrupted or terminated due to the relevant requirements of national laws, regulations and policies.
VI. Agreement changes
In order to meet your diversified and specialized service needs, we may add or change the service content or service mode according to Singapore laws and regulations and business needs, and we may make changes to the content of this agreement and announce them in advance by publishing announcements on the official website of eSign (www.antesign.com). If you do not accept the changes to this Agreement, you have the right to choose to stop using the Service at your own discretion. If you continue to use the Service after the effective time agreed in the announcement, it means that you have fully read, understood and accepted the content of the modified agreement.
VII. Applicable Law and Jurisdictional Provisions
This Agreement shall be governed by and construed in accordance with the laws of Singapore. In the event of a dispute between eSign and you regarding the signing, performance or interpretation of this Agreement, both parties shall endeavor to resolve it through friendly negotiations. If no negotiation is reached, both eSign and you agree to submit to arbitration by the Singapore International Arbitration Centre.
